New Delhi, October 17: The Supreme Court has agreed to consider the petition filed by Aam Aadmi Party (AAP) MP Raghav Chadha against his suspension from the Rajya Sabha.
The Upper House Secretariat is headed by Chief Justice of India D.Y. A bench headed by Chandrachud has issued notice and sought a reply in the matter by October 30. Justice D.Y. The bench headed by Chandrachud comprised Justice Manoj Mishra and Justice J.B. Pardiwala is also included.
Considering the importance of legal issues in this case, the bench asked Attorney General R. Venkataramani’s cooperation has also been sought.
Senior advocate Rakesh Dwivedi, appearing for Aam Aadmi Party (AAP) MP Raghav Chadha, said during the hearing that this case involves an issue of national importance and the Rajya Sabha Chairman has ordered the suspension of a member of the House pending the investigation. Can’t give. When the Privileges Committee is already engaged in the investigation process, then the Chairman of Rajya Sabha cannot give such orders at all.
Senior advocate Rakesh Dwivedi said that in the past, the names of those members who were not signatories in the list of the proposed select committee were removed from the list.
Aam Aadmi Party (AAP) MP Raghav Chadha was suspended from the Rajya Sabha in August. He is accused of having forged signatures in a motion related to the Delhi Services Bill of five MPs. Those five MPs had filed a complaint against Raghav for breach of privilege. After which he was suspended from Rajya Sabha. Last week, Chadha had approached the Supreme Court regarding this matter.
Raghav Chadha has been suspended from the Rajya Sabha until the Privileges Committee submits its final report.
House leader Piyush Goyal had moved the suspension proposal. Piyush Goyal termed the action taken by Chadha as unethical.
